Terms of Service

Welcome to Melodian. By accessing or using the Melodian platform, including the web application at play.melodian.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.


1. About Melodian

Melodian is an AI-powered piano analysis platform that connects to your digital piano via MIDI to deliver real-time performance feedback, scoring, and practice insights. The Service analyses MIDI data transmitted by your instrument to produce metrics such as note accuracy, timing, dynamics, and an overall performance rank.

The Service is currently in a limited beta release. Features, pricing, and availability may change as we develop the product.

2. Beta Programme

By joining the beta, you acknowledge and agree that:

  • The Service is provided as an early-access beta and may contain bugs, incomplete features, or other issues.
  • Features may be added, changed, or removed at any time without notice.
  • The Service may be temporarily unavailable due to maintenance or instability.
  • Beta access is personal, non-transferable, and may be modified or revoked at our discretion.
  • You may be invited to provide feedback to help improve the product; such feedback may be used by Melodian without obligation or compensation.

3. Eligibility

You must be at least 13 years of age to use Melodian. If you are under 18, you must have the consent of a parent or legal guardian to use the Service, and they must agree to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

4. Account Registration and Beta Access

To access the beta, you must submit a sign-up request providing accurate and complete information, including your email address. Melodian reserves the right to accept or decline any access request at its sole discretion.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

5. MIDI and Performance Data

When you connect a MIDI-enabled instrument and use the Service, Melodian processes the MIDI signals transmitted by your device. This data includes note events, timing, velocity, and pedal information. This performance data is used to generate your personalised analysis, scores, and rankings.

You retain ownership of your musical performances. By using the Service, you grant Melodian a limited, non-exclusive licence to process and store your performance data for the purpose of delivering and improving the Service. Anonymised or aggregated performance data may be used to train and improve our analytical algorithms. Please refer to our Privacy Policy for full details.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive source code from any part of the Service.
  • Reproduce, sell, or redistribute the Service or any portion of it without our express written permission.
  • Interfere with or disrupt the integrity, performance, or security of the Service or its underlying infrastructure.
  • Share your beta access credentials with others or allow third parties to access the Service through your account.
  • Upload or transmit any malicious code, scripts, or data that could harm the Service or other users.

7. Intellectual Property

All content, software, algorithms, visual designs, branding, and technology comprising the Service are the property of Melodian or its licensors and are protected by intellectual property laws. These Terms do not grant you any right, title, or interest in or to the Service beyond the limited right to use it as described herein.

The name "Melodian", its logo, and all related marks are trademarks of Melodian. You may not use these marks without our prior written consent.

8. Third-Party Devices and Services

Melodian integrates with MIDI-enabled instruments via the Web MIDI API and may interact with third-party browser capabilities and operating system services. We are not responsible for the performance, accuracy, or compatibility of third-party hardware, software, or APIs.

Access to the Web MIDI API requires a compatible browser and may prompt a permission request. You are solely responsible for granting or denying such permissions on your device.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Melodian does not warrant that the Service will be error-free, uninterrupted, or free from viruses or other harmful components. Performance scores, rankings, and analysis results are provided for informational and educational purposes only and do not constitute professional musical instruction or assessment.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MELODIAN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

In no event shall Melodian's total liability to you for any claims arising out of or related to these Terms or the Service exceed the amount paid by you to Melodian in the twelve months preceding the claim, or £50, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Melodian and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your breach of these Terms, or your violation of any applicable law or the rights of a third party.

12. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practical, notify registered beta users by email. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms.

13. Termination

Melodian reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Provisions of these Terms that by their nature should survive termination will remain in effect after termination, including intellectual property, disclaimers, and limitation of liability.

You may stop using the Service at any time. To request deletion of your account data, contact us at legal@melodian.app.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by applicable consumer protection law in your jurisdiction.
